The federal law that addresses the rights and needs of special education students, known as the Individuals with Disabilities Education Act (IDEA), was reauthorized by the U.S. Congress in 2004. The new federal regulations created based on the IDEA 2004 reauthorization became effective October 13, 2006. IDEA 2004 requires many changes to the current provisions of special education for local education agencies. In response to these new federal regulations, the Georgia Department of Education (GaDOE) is required to revise the current set of State Board of Education rules that address special education students. Based on the changes in federal law, the GaDOE drafted revisions of the proposed rules and released them for public comment. The GaDOE formally conducted 11 input sessions throughout the state in December 2006 and January 2007 and also accepted general public comment. In addition the GaDOE met with and received comments from the Georgia Association of Educational Leaders which included invited representatives of the Georgia Association of Elementary School Principals, Georgia Association of Middle School Principals, Georgia Association of Secondary School Principals, Georgia Association of Curriculum and Instructional Supervisors, Georgia School Superintendent Association, and Georgia Council of Administrators of Special Education as well as selected attorneys representing local education agencies, selected attorneys specializing in the representation of families of students with special needs, and special education directors throughout the state. All comments and feedback were reviewed and used in the creation of Revision 2 of the state’s special education rules.

Listed below is Revision 2 of the proposed rules. They include a summary of the major comments on each rule and the changes made from Revision 1 to Revision 2; a side by side version with the federal regulation and the proposed state rule; a tracked changes version from Revision 1 to Revision 2; and a clean copy of proposed Revision 2.

The GaDOE’s Division for Exceptional Students has created a statewide committee to develop an Implementation Manual to correspond to the State rules for special education. The Implementation Manual will provide the sample forms for special education as well as other implementation guidance. The proposed release date for the Implementation Manual is July 1, 2007.

The following schedule is currently being followed for the adoption of the special education rules though these dates are tentative and subject to change:

March 1, 2007 Revision 2 of the special education rules are released for public comment and review. A webcast explaining the changes to the rules will be conducted at 1:00PM but no comments will be accepted at this time. The purpose of this webcast is only to introduce and catalogue the changes made to the current revision.

March 6, 2007
